Hello to all newcomers – this is my first blog on siberkhem.com, this one using WordPress – I hope to have also a parallel blog using Drupal – the contents in the two blogs are expected to cover the general topic of patents, which may include patents in the current media and current events, intellectual property generally, and, particularly the organization of patent and related technical information, or its ontology, taxonomy, and classification
I have had a single previous blog that was parked on blogspot, in which I made 25 posts from Dec 2007- Apr 2008 – I plan to transfer a copy of those posts here, or at least link them here
In this and subsequent postings of this blog, I especially expect to cover the methodology of a thorough and diligent patent search and how a “template” can properly be used, and a report structure and report analysis that describes a satisfactory search for a given type of patent search
first, let’s ask the following three specific questions before even considering the technical (i.e., “patentable”) merits of the inventive concept being sought
1: is the search requester the patent holder or the competitor of a patent holder, currently involved in ongoing or imminent anticipated litigation (e.g., infrigement or validity search), i.e., commercialization has already begun?
2: is the search requester an inventor or invester in an impending commercial operation, or scale-up, i.e., (e.g., infringement avoidance or pre-licensing survey, “due diligence”)?
3: is the search a general market survey, i.e., for determining market position prior to pilot scale effort, including “fishing expeditions”
the answers to these questions can give a searcher a general idea regarding how much or the type of information that the search requester is expecting to receive, and “needs” to receive to make a subsequent decision
it is ASSUMED that the patent search requester requires the information sought in order to make a SUBSEQUENT DECISION – if no “decision” is needed, based on the search results, then there is no need for the patent search, of course – in my next posts, I’ll explain the differences between the types of search efforts and report results format, etc. that address each of the combination of responses to the above three questions
